RENT-A-SPACE CHECKLIST?

juliansampson.jpg If you are considering renting out space to a beauty therapist, rather than incorporating the service into your own business, here is Salon Smart legal expert Julian Sampson' essential checklist.

 

1.
Does the partnership constitute a good image fit with the style and ethos of the salon? Treat it like a marriage – if you don’t like the way they do things, don’t do it.

2. Check the employment status of your beauty partner – is the beautician a consultant on a self-employed basis and is therefore liable for their own tax affairs and their own employees?

3. The license should set out formal working hours – whilst this might sound like an employment situation it simply creates a contractual relationship that ensures the salon can enforce terms on the beautician in the event of, for example, constant absenteeism.

4. Check the licence is allowed under the terms of the lease of franchise agreement. Many premises cannot enter sub-letting and any such relationship would almost certainly breach of a franchise agreement for the larger groups.
